On September 21, 2018, Encore Wire Corporation and Southwire Company (the petitioners) filed new US antidumping (AD) and countervailing (CVD) duty investigations against imports of aluminum wire and cable from China. The investigations are related to duties of antidumping and countervailing. The petition applies to a variety of products, including particular types of aluminum wire and cable, which are typically utilized for the transmission of electrical power in a variety of residential, industrial, and commercial settings. Margin estimates for AD and CVD according to the petitioner The petitioner has alleged the following AD margins: China - from 53.2 percent to 63.1 percent The petition asserts that CVD margins for China are greater than the de minimis threshold. Products that fall under the purview of the investigation in this case: The investigations will focus on aluminum wire and cable (abbreviated as "AWC"), which is defined as an assembly of one or more electrical conductors made from 8000 Series Aluminum Alloys, Aluminum Alloy 1350, and/or Aluminum Alloy 6201, provided that all of the following conditions are met: (1) at least one of the electrical conductors is insulated; (2) each insulated electrical conductor has a voltage rating that is greater than 80 volts but does not exceed 1000 volt The American Society for Testing and Materials (often known as "ASTM") B800 is the standard by which 8000 Series Aluminum Alloys are categorized. The specification that ASTM B230/B230M or B609/B609M must be followed in order to define aluminum alloy 1350. ASTM B398/B398M provides the definition that is used to categorize Aluminum Alloy 6201. The assembly might or might not have the following components: (1) a grounding or neutral conductor; (2) a cladding made of aluminum, steel, or some other base metal; or (3) a steel support center wire, one or more connectors, a tape shield, a jacket or some other covering, and/or filler materials. The vast majority of AWC products are compliant with the National Electrical Code (NEC) types THHN, THWN, THWN-2, XHHW-2, USE, USE-2, RHH, RHW, or RHW-2. These products are also compliant with the Underwriters Laboratories (UL) standards UL-44, UL-83, UL-758, UL-854, UL-1063, UL-1569, UL-1581, or Conductors that were already assembled in equipment at the time of importation are not covered by the petitions since their scope clearly excludes covering those conductors. Products made of aluminum wire and cable that are less than six feet in length are not included either. Certain aluminum wire and cable that is the focus of these investigations can be appropriately classified as falling within the scope of subheading 8544.49.9000 of the Harmonized Tariff Schedule of the United States ("HTSUS"). The wire and cable made of aluminum in question may also be imported under the HTSUS category 8544.42.9090.
